Question 17: As of December 31, 2022, the following matters were active and pending in state and federal courts - Doris M. Nichols v. SEIU Local 73 (22-CV-04881): Ms. Nichols sued the Union in the Northern District of Illinois, claiming that she is owed $70,000 in benefits from her late husband's pension. To date, it is unclear upon what she bases this claim. On March 1, 2023, the Union filed a Motion for Judgment on the Pleadings. The Union views this as a totally frivolous suit that fails to state a claim upon which relief can be granted. A briefing schedule has been set with the Unions final Reply brief due on April 5, 2023. In another action previously pending before the Northern District of Illinois(Case Number 18-CV-02728), the two former officers/employees of the Union, Christine Boardman and Terri Barnett, contest their removal from their officer and employment positions. On September 30, 2022, the union was granted summary judgment seeking dismissal of the lawsuit. Boardman filed an appeal of the decision with the Seventh Circuit Court of Appeals (No. 22-2957). The parties are currently briefing the appeal. Terri Barnett did not appeal the decision and dropped from the case. As of December 31, 2022, the following relevant matters were active and pending before adjudicatory commissions at state and federal agencies. On October 18, 2022 a hearing was held at the Illinois Human Rights Commission before Administrative Law Judge William Borah. This hearing related to age discrimination claims brought by former employee Terri Barnett. The parties are currently briefing this matter.
